Appeals
Tim Cullen and Tasha Taylor both enjoy a strong appellate practice. Over the last several years, the firm has been involved in over 60 cases on appeal, and won several important victories in the areas of criminal law, child custody, insurance law, workers compensation, and tort law.
The firm, as lead counsel for the Appellants in Green v. Alpharma, Case No. 07-382 (Ark. S. Ct., May 8, 2008), recently succeeded in overturning a trial court decision in a toxic tort case that has gained some notoriety for being the largest trial record ever filed in an Arkansas appellate court.
The firm also recently prevailed as lead counsel for the Appellees in a nationwide class action certification appeal to the Arkansas Supreme Court in General Motors Corporation v. Bryant, Case No. 07-437 (Ark. S. Ct., June 19, 2008).
Both of these decisions have received local and national media attention. Our appellate practice continues to grow because many Arkansas lawyers who do not routinely handle appeals seek our expertise and experience.
We also represent indigent criminal defendants as court-appointed counsel on appeal before the U.S. Court of Appeals for the 8th Circuit, and the Arkansas Supreme Court and Court of Appeals. View our firm's Appellate Blog at ArkansasAppeals.com.
Collections
Tim Cullen and his staff represent two large collection agencies and several banks, credit unions, and both small and large businesses, in collecting delinquent accounts.
The firm is also counsel to six companies that manage and collect delinquent consumer credit card debt. In the collection practice, members of our firm appear in circuit and district courts throughout the state on a routine basis.
The firm is a member of the American Collectors Association Members Attorney Program, and is well versed in the regulations governing consumer and commercial collections.
Medical Malpractice, Products Liability and Personal Injury
Cullen & Co. has recovered millions of dollars in settlements and verdicts for clients who were injured due to the negligence of others. From simple car wrecks that cause substantial injuries, to complex medical cases involving infectious diseases, sudden cardiac death, or cerebral aneurysms, members of the firm have the experience and resources to accurately evaluate liability issues, prove causation, and illustrate the damages caused by these negligent acts.
We utilize video and computer technology to bring trials to life, and incorporate medical illustrations, models, and day-in-the-life type videos to make our cases compelling. While we have tried numerous significant cases to verdict, in our experience most of these cases are successfully settled prior to trial.
Federal Tort Claims
Federal Tort Claims are brought under the Federal Tort Claims Act by individuals who are injured by employees or agents of the federal government. That Act generally allows a person injured by a government employee or agency to file an administrative claim for compensation.
Business Litigation and Business Planning
We have experience representing local businesses in sales and acquisitions, non-compete litigation, and developing forms and processes to help businesses avoid conflicts and litigation. We are able to form business entities for clients, and advise on the advantages and disadvantages of various business forms, such as subchapter S corporations, subchapter C corporations, LLCs, partnerships, and sole proprietorships.
